These terms & conditions of agreement form a legally binding service agreement (the "Agreement") between Vats Ventures Private Limited and/or its subsidiaries and affiliates ("VATS 24", "we", "us", "our") AND Users/ Vendors ("User(s)", "you", "your", "yourself", "vendor(s)").

VATS 24 facilitates in booking a bed in a hostel/PG and/or seat in a library (collectively, the "Services") which are accessible at www.vats24.com, mobile application, call centres (collectively referred to as "VATS 24 Platform") which enables the User (person(s) using VATS 24 Platform to book a bed in hostel/PG and/or a seat in library)/ Vendor (person(s) offering their property on VATS 24 Platform to be rented as a hostel/PG/library) to connect with us in relation to the services offered through the VATS 24 Platform. By using VATS 24 Platform, you agree to comply with and be legally bound by the terms and conditions of these Terms of Service ("Terms"), whether or not you become a registered user of the Services.

These terms & conditions govern your access to and use of the Vats 24 Platform and Services and all Collective Content. We reserve the right to modify these Terms at any time at our sole discretion. It will be your responsibility to keep yourself updated with the Terms from time to time, your continued usage of the VATS 24 Platform and Services would be deemed to be an acceptance of these terms & conditions and the modifications thereto. Please read these terms & conditions carefully before accessing, using, obtaining or availing any services from VATS 24 Platform. If you do not agree with these terms & conditions, you may refrain from using the VATS 24 Platform and/or Services. These terms & conditions must be read in conjunction with any other applicable terms and conditions governing the use of VATS 24 Platform and Services.

TERMS & CONDITION

  • GENERAL TERMS & CONDITION
    • If the user(s) is not a major, (less than 18 years of age) it shall be the duty of the parent/ guardian of such user(s) to cause and procure the minor to adhere to the terms and conditions set hereunder.
    • User(s) must fill the sign-up form on VATS 24 Platform truthfully with the best of their knowledge, they shall upload their valid ID's only (it will be subjected to verification by the vendor).
    • User(s) must upload their most recent photos (Maximum six weeks old), for better identification purpose. Booking shall not be deemed to be complete till verification of photo is not completed.
    • Discrepancy, if any, found in case of filling of the sign-up form, the user shall be held responsible and his/her account on VATS 24 Platform shall be blocked or deleted in case of proven misconduct or fraudulent behaviour.
    • Any user(s) found harming/damaging the property of the vendor(s) that he/she resides in or studies in, shall have to indemnify the loss or might also have to pay an additional penalty if the case so warrants.
    • No bed or seat shall be deemed to be booked without prior payment made either through online or offline payment mode in full amount (both in case of online and offline bookings).
    • Money deposited by the user shall be credited to the vendor within reasonable time, dispute, if any arising out of such transaction shall be between the user and the vendor. VATS 24 is merely a facilitator and hence, will have no part in such a dispute except in cases of online payments.
    • VATS 24 is an independent entity and is neither a representative nor an agent of the Vendor, the user(s) are advised to verify the details provided by the Vendor(s), VATS 24 shall not be responsible for any dispute arising out of them, nor shall it be obligated to mediate or resolve any dispute between the user and the vendor.
    • Vendor(s), if found providing falsifying information about his/her premises, VATS 24 shall have the right to remove such vendor from its portal, which might also lead to a complete prohibition by the portal.
    • The tariffs of an accommodation/library may differ from month to month, that is the sole prerogative of the vendor, VATS 24 shall not be held accountable for the properties it does not own, manage or control.
    • It shall be the principal responsibility of the vendor(s) (hostel/PG only) to update electricity meter readings in the user's data in his vendor panel on VATS 24 Platform as and when required by VATS 24 Platform to be updated, failing which, in case of any discrepancy in the data, caused due to the negligence of the vendor, VATS 24 shall not be held accountable
    • In case of new bookings, the meter reading in hostel/PG shall be taken as the reading at which the last user left, but if the vendor and the user agrees to any other agreement then they are solely responsible for such outcome and VATS 24 won't have any liability arising out of any such outcome.
    • In case there is a gap of more than 10 units (in case of hostel(s)/PG(s)) between last/previous user booking and new user booking then the new user can have the option to pay according to the unit at his/her arrival date (this clause is not applicable in case of bed booked in advance).
    • VATS 24 is merely a facilitator between the user(s) and vendor(s) and shall not be liable for any damages or injury caused due to the failure of performance, theft, breach of contract, negligent behaviour, or any other kind of loss arising out of conduct of either of the parties.
    • User(s) shall be bound by directives of the vendor(s) which shall be in addition to, though not limited to the general rules laid down by VATS 24
    • VATS 24 uses a third party gateway to receive payments from user(s). We shall not be held responsible for any erroneous transaction, delay in processing payment, cancellation of booking due to payment issues etc. Even though we apply extreme caution while collaborating with third party payment providers, we do not control their technology and systems and therefore cannot be held accountable for a fault at the end of payment gateway service provider(s).
    • Fee amount and Subscription amount for User's and Vendor's respectively can change anytime by giving just one month prior notice/notification on their respective notification panel.
    • The "Rules & Regulations" mentioned on the Vendor(s) profile for User(s) will be followed in priority to the rules and regulations mentioned on VATS 24 Platform for User(s).
  • Renewal Policy
    • User(s) interested to extend his/her stay in the same seat/bed, can do so within three days prior to and post the expiration date of current booking in case of hostel(s)/PG(s) and three days prior to the expiration date of current booking in case of Libraries. Failure to do so, shall entail vacating the seat(s)/bed(s).
    • Irrespective of the booking/renewal of the booking date, it shall always be a month's cycle and will not be affected by the date of renewal of seat(s)/bed(s).
    • Prices being volatile, there can be dissimilarity between the booking and renewal/extension price of seat/bed. Prices are subject to availability of seats and discretion of vendor(s).
    • Vendor(s) shall have a right to turn-down an extension/renewal on grounds of proven misconduct, misbehaviour and damage to property in the past.
    • The vendor(s) shall have the right to terminate a booked seat/bed on grounds of proved misconduct, misbehaviour and any loss to property, in which case the user shall have to vacate the property with immediate effect, VATS 24 shall have no role to play in this matter.
    • In case of loss/damage to property, the vendor shall have a right to forfeit the security money along with immediate evacuation of the user from the premises. VATS 24 shall have no role to play in this matter
  • Shifting Policy
    • VATS 24 will not form party to this transaction and is only providing software for the ease of this process, and can't be held accountable for any discrepancy occurring due to this transaction and only the user and the vendor will be individually responsible for any such transaction through mutual consent.
    • In case the user wants to shift his/her seat/bed to another seat/bed within the same property, then in that case he/she shall send a request for the same through VATS 24 Platform to the vendor, and if the vendor find it OK then he/she can allow the shift (it is solely up to the vendor's discretion and VATS 24 has no role or liability in between)
    • In case of a shift in seat/bed, any dues remaining from the last seat/bed like fees and electricity (in case of hostel) if applicable, shall have to be cleared first by the user
    • It shall be the responsibility of the vendor to update the electricity meter reading at time of shifting and also as and when required by VATS 24 Platform (in case of hostel(s)/PG(s)).
    • Shifting of bed in case of hostel will happen after the mutual consent of both the parties i.e. users and vendors both.
    • Shifting of seat in case of library is up to the sole discretion of the library vendor.
  • Cancellation/ Termination policy at VATS 24 Platform
    • Cancellation/ Termination in case of Current Booking (applicable for hostels/PGs only)
      1. It is imperative for the user to give a 15 days' (or more as per vendor's "Cancellation Policy" mentioned on VATS 24 Platform) notice before leaving the premises, failing which, the security amount shall stand forfeited. Similarly, the vendor shall also give a 15 days' (or more as per vendor's "Cancellation Policy" mentioned on VATS 24 Platform) evacuation notice to the user before asking him/her to vacate the premises.
      2. Upon mutual agreement of both the parties, i.e., the vendor and the user, the vendor may agree to refund full or part amount to the user by issuing a credit note through VATS 24 Platform; VATS 24 being no party to this transaction.
      3. VATS 24 Platform has a no refund policy.
    • o Cancellation/ Termination in case of advance booking (applicable for hostels/PGs only)
      1. In case of advance booking, user(s) can book their bed(s) in advance for up to 7 days by paying the required amount of rent and the remaining dues of rent & security deposit, if any, must be paid to the hostel vendor up to the booking date through online or offline modes.
      2. In case of cancellation of advance booking, where transaction done through online/offline mode, no amount shall be refunded through VATS 24.
      3. Upon mutual agreement of both the parties, i.e., the vendor and the user, the vendor may agree to refund full or part amount to the user by issuing a credit note through VATS 24 Platform; VATS 24 being no party to this transaction.
      4. VATS 24 Platform has a no refund policy
    • Cancellation/Termination in case of proved misconduct, nuisance, forgery, non-payment of dues and/or harming/damaging the property of the vendor by the user(s).
      1. The vendor shall have extraordinary right to request the user to vacate the premises within 48 hours, wherein VATS 24 shall not be a party in the matter.
      2. In special circumstances including damage to property but not limited to damages, the vendor(s) hall have the right to forfeiture the rent and security deposit money in case of damage to the property and proven misconduct, wherein VATS 24 shall not be a party in the matter.
      3. No refund shall be pre-arranged, if a cancellation is made during or in-between months, other than the conditions specified above. Though, nothing can stop the vendor and user to mutually agree upon an aggregable term benefitting both the parties.
  • Responsibilities of Users
    • The user(s) shall be entirely responsible to maintain his/her profile on VATS 24 Platform, their personal information shall be protected by us, by virtue of our Privacy Policy.
    • The user(s) shall be responsible to keep himself/herself abreast with the modifications, or alterations or amendments in the VATS 24 Platform, failing which, the vendor or we cannot be held liable for missing any notification.
    • The user(s) shall be held accountable for any theft or loss of his/her data due to his/her negligence.
    • The user shall not provide any falsified, inappropriate or misleading information about him/her on his/her profile on VATS 24 Platform.
    • In case of delay in replying to messages or notification beyond reasonable time (maximum 48 hours), an ex-party decision shall be taken considering the general profit of all.
    • If the user fails to read notification(s) or message(s) regarding any kind of change in the facilities or rates of the vendor, then he/she will be held accountable for negligence and won't be able to claim any refund and will have to comply by the changes so made.
    • If an account doesn't show much of activity for a reasonable time, it shall be deemed to be shut down.
    • Money, if any, lost in payment due to the breakdown of payment gateway shall be the obligation of the bank and the user and/or VATS 24/ Vendor shall not be liable for any such transactions in any which way possible.
    • User(s) shall make timely payment of all of their dues.
    • It shall be the user(s) duty to conduct oneself in an orderly and acceptable manner and not get into any arguments and fights, and in case of any grievances, directly write a note to the vendor through VATS 24 Platform.
    • The user(s) shall take utmost care and caution while residing in the premises of the vendor, it is his/her duty to use the premises as his/her own property and not cause any harm to it.
    • It shall be the user(s) duty to keep the surroundings neat and clean.
    • It shall be the user(s) responsibility to take care of their belongings and nobody else will be responsible for any kind of damage, theft or misplacement of their property.
    • It shall be the user(s) duty to not create a problem for other user(s).
  • Responsibilities of Vendors
    • The vendor(s) shall maintain an updated account on VATS 24 Platform for the mutual benefit of the user(s) and VATS 24.
    • The vendor(s) shall make appropriate payments at the opportune time (subscription payments) towards VATS 24, failing which VATS 24 shall have the right to suspend vendors account from its platform or levy a penalty for delayed payment as the case maybe,
    • Vendor(s) shall be obligated to verify the photo(s) & ID(s) amongst other details of the user(s), failing which the user's admittance shall not be complete.
    • The onus shall be on the Vendor(s) to send notification/messages, to the user(s), for keeping them appraised of modification, alteration, amendment of important changes, failing which, VATS 24 shall not be held accountable for any misrepresentation on the part of the vendor(s).
    • The onus to reply to user(s) messages shall be upon the Vendor, failing which, any loss caused shall be reimbursed by the vendor. VATS 24 shall be abstained from any liability of the same.
    • Vendor(s) shall always keep his profile updated, failing which, the resultant loss shall be borne by the vendor(s) itself.
    • The vendor(s) may make appropriate amendments to rent, electricity facilities, etc., provided the vendor(s) shall send 1 month's prior notice to all users, failing which the user shall have a right to get refund or terminate his/her bookings.
    • The Vendor shall be duty bound to provide all the facilities as being promised on VATS 24 Platform, failing which, he shall be given notice of compliance. Upon further complaints, his account shall be terminated from VATS 24 Platform after sending him an agreement for termination of services.
    • Vendor(s) shall be duty bound to comply with law of the land applicable on them.
    • Vendor(s) shall be duty bound to comply with any kind of direct or indirect tax applicable on them and VATS 24 will not be responsible for any kind of non-compliance on their part.
    • Vendor(s) shall be duty bound to ensure the physical and mental well-being of all his/her registered user(s).
    • Vendor(s) shall be duty bound to keep their premises neat and clean and up to the standards of habitability.
    • Vendor(s) shall be duty bound to make user(s) feel safe and secure in their premises.
    • Vendor(s) shall beduty bound to charge user(s) according to their usage of facilities and not levy any additional charge
  • Terms regarding Payments
    • For using any of the payment's method available on VATS 24 Platform, VATS 24 shall not be held accountable, whatsoever in respect of any loss suffered directly or indirectly by the user(s) or vendor(s) due to any of the following reasons:
      1 Lack of authorization for any transaction
      2. Double transactions
      3. Money being deducted and transaction getting dropped
      4. For making any wrong transaction
      5. Exceeding the present limit mutually agreed by you and the bank
      6. Any payment issue arising out of the transactions
      7. Decline of transaction for any other reasons
    • VATS 24 is a facilitator between the user(s) and vendor(s) and it shall in no way be held accountable for the transaction between the two parties.
    • The payment made by user(s) goes directly to the vendor(s) subject to applicable taxes & charges, within 10-15 working days, in case of any grievance and/or refund, the user(s) shall directly approach the vendor. VATS 24 shall in no way be accountable for such transaction, as it is only a facilitator between the user(s) and the vendor(s).
    • User(s)/vendor(s) have specifically authorized the VATS 24 or its service providers to collect, process, facilitate and remit payments and/or the transaction price electronically. Your relationship with VATS 24 shall be on a principal to principal basis and by accepting these Terms, you agree that VATS 24 is an independent contractor for all purposes, and does not have control of or liability for the services that are listed on VATS 24 Platform that are paid for by using the payment facility.
    • The user(s) and vendor(s) shall agree to the terms and conditions provided by the payment gateway provider, by choosing the payment portal, it is not a service provided by VATS 24, therefore, VATS 24 shall not be held accountable for issues regarding the portal.
    • If the user fails to read any notification regarding any kind of change in the facilities or rates of the vendor, then he/she will be held accountable for negligence and won't be able to claim any refund and will have to comply by the changes so made.
  • Usage rights on VATS 24 Platform
    • The user(s) and vendor(s) shall agree that they shall be given limited rights as may seem fit by VATS 24 by signing in to the VATS 24 Platform.
    • The user(s) and vendor(s), by signing in, shall agree to not use VATS 24 Platform in such a way that it shall be harmful to VATS 24 in any which way possible.
    • User(s) and Vendor(s) shall not use VATS 24 Platform so as to infringe intellectual property of third party, fraudulent activity, trade secret or other propriety rights or privacy policy of a third party.
    • User(s) and Vendor(s) shall not use VATS 24 Platform so as to track or copy any information or material, strategy, logo, trademark etc. to the detriment of VATS 24 or any other third party associated with VATS 24 in any capacity.
    • The user(s) and Vendor(s) registered with VATS 24 Platform have given them the right to use and manage their data as they deem fit, without being of any detriment to themselves or of any other party.
    • The user(s) and Vendor(s) registered with VATS 24 Platform have agreed to provide their data for research purposes in order to develop better equipped services for the future.
    • VATS 24 reserves the right to protect the confidentiality of the sensitive data being given to them and abstain from sharing the same with a third party.
    • By signing in with VATS 24 Platform all the user(s) and vendor(s) have given a right to VATS 24 Platform to keep their data private and secure and not share it with any third party unless such data is being summoned by any government agency or court for any official or unofficial use.
    • VATS 24 may use the VATS 24 Platform to send personalized messages/notifications to any or all of its user(s)/vendor(s) individually, randomly or simultaneously to all.
  • Breach of responsibility by user(s)/vendor(s)
    • VATS 24 shall have the right to terminate an agreement (partially or completely) with its vendor(s)/ user(s), if found in violation of any agreement made between the parties or does an act which in the sole discretion of VATS 24 is unacceptable.
    • Upon termination of agreement (when found in violation to agreement), VATS 24 shall have the right to block or cancel the profile of any user(s)/vendor(s) and forfeit the money held by us on behalf of vendor/user. Further, VATS 24 may take necessary action, as it deems fit for the occasion.
  • Intellectual property rights
    • All the contents on VATS 24 Platform shall include but will not be limited to photos, logos, button icons, data, software, audio-visual interface etc. or any other information, protected, owned, controlled and licensed to the intellectual property of VATS 24 and no one except VATS 24 has any right on the above-mentioned property.
    • Through the usage of VATS 24 Platform, the user(s) and vendor(s) have granted a limited, non-exclusive, non-transferable right to use the content and materials on the Website in connection with its normal, non-commercial, use of the Website. Wherein, it is restricted to copy, reproduce, transmit, distribute, or create derivative works of such content or information without express written authorization from VATS 24.
    • All the process and links are the property of VATS 24 and only VATS 24 has a right to the ownership and process rights over it.
